LAW312: Public Law II

The unit deals with recent developments in Australian federalism and draws upon the comparative analysis of American and Canadian constitutional jurisprudence. The growing importance of group rights as they affect the constitutional status of women, Aborigines, immigrants and multiculturalism is also examined. Administrative law will be examined through an extended case study of the judicial review of immigration law and policy from Federation to the present day. The Constitution and the economy are considered in relation to freedom of interstate trade, the corporations power and the power of corporations. The final part of the unit deals with a number of problems relating to citizenship and constitutional reform, including civil rights and civil liberties, bills of rights and the question of an Australian republic.
