LAW500: Litigation

This unit will critically examine civil and criminal procedure including fundamentals of the law of evidence and advocacy in the context of both litigation and alternative methods of dispute resolution. Civil procedure using Supreme Court Rules will focus upon selected topics concerning jurisdiction, parties, the initiation and service of process, pleadings, judgement, appeal, enforcement, costs, case-flow management techniques and other issues including ethical conduct relating to the role of lawyers, judges, courts and tribunals under current adversary and non-adversarial dispute resolution systems.

In the context of criminal procedure, pre-trial issues associated with arrests, warrants, interrogation, searches, convictions and appeals will be examined. Throughout the course particular attention will be given to evidentiary issues and how they relate to civil and criminal matters. Comparisons with other jurisdictions will be highlighted where appropriate.
