LAW508: Comparative Law |
This unit aims to provide a theoretical framework and preliminary knowledge to enable students to undertake analyses of non-common law legal cultures. The unit will not provide instruction in foreign law (that is, the legal systems of other countries) but, rather, a comparative approach to law. The unit has five components: methodological and theoretical; civil law (continental European) culture; Islamic legal culture; Hindu legal culture; and Chinese legal culture. The last component may change from year to year (for example, legal change in post-communist countries). The unit has a research orientation. It is intellectually challenging and is strongly recommended to students interested in the theoretical study of law and in understanding law as a social phenomenon.
