LAW529: Property Rights

This unit will examine the interaction between law and property rights.

In 1765 William Blackstone advised his contemporaries: 'There is nothing which so generally strikes the imagination and engages the affections of mankind as the right of property...And yet there are very few, that will give themselves the trouble to consider the original and foundation of this right.' Blackstone's observation is as true today as it was then. Decisions such as Mabo in Australia and Delgamuukw in Canada remind us that property is contested terrain. This is because the concept of and laws regulating property reflect diverse cultural and historical contexts.
