LAW417: Aspects of Communication Law |
This unit canvasses competing 'public' and 'private' orientations as expressed in statute and common law, in relation to publication offences arising out of allegations of sedition/racial vilification, breaches of national security, offensive conduct (obscenity/blasphemy), as well as defamation, and contempt. Two contemporary phenomena - technological convergence and globalisation - motivate the unit's consideration of (a) the trifurcated regulatory models that emerged historically in relation to print, common carriers and broadcasting, and (b) the capacity of the nation-state to maintain its regulatory order.
