LAW422: Sales and Consumer Law |
This unit attempts an overview of modern consumer law. In this context it places the Sale of Goods Acts of the States, particularly the provisions that were re-enacted in Part V of the Trade Practices Act 1974. Part V then becomes the main legislative focus of the unit and is considered in its original design as the Commonwealth's comprehensive code of consumer protection, regulating unfair practices in the supply of goods and services, and its development as Australia's new commercial law. The uniform Consumer Credit legislation is also looked at as a case study in consumer protection. The topics in the unit lead to a consideration of the utility of the concept of 'consumer', the role of statutory authorities, government departments and the consumer movement.
