LAW867: Water and Marine Resources Law

The first half of this unit examines the principles that govern the ecologically sustainable use and management of water resources, including an analysis of relevant international principles and conventions, constitutional issues, the legal nature of a right to water and its allocation, indigenous access and the Australian water law framework and industry. These issues will be discussed by reference to case studies drawn from a number of jurisdictions including the Murray Darling Basin. The second half of this unit evaluates international conventions, legislation and other management tools relating to the marine environment. Specific attention will be given to land-based marine pollution and pollution from ships, the protection and preservation of the marine environment under UNCLOS, and specific marine environmental issues including community based marine conservation, the deep sea bed, whaling and Antarctic living marine resources. This unit evaluates the efforts of the global community with respect to enforcement and compliance.
