LAW203: Torts
This unit examines the law of torts and its operation in context from a practical, theoretical and normative perspective. The unit builds on and extends knowledge and skills gained in LAW114, LAW115, LAW204 and LAW208. The law of torts addresses the question of social responsibility between and amongst members of a community. It asks us to think about what obligations we owe to others, and how legal standards can and should be used to encourage appropriate behaviour. The unit examines the philosophical foundations of fault and responsibility, and begin to consider the aims, purposes and rationale of the law of torts, including compensation for wrongs. The main focus is on the law of negligence, the most significant of the modern torts. Other topics discussed include assault, battery, false imprisonment, trespass to land, nuisance, conversion, and defences.
