LAW415: Dispute Management and Resolution
Dispute resolution schemes now dominate the practice of law at many levels. This unit explores the various types of dispute resolution processes in operation in Australia and overseas with an emphasis on negotiation, mediation, arbitration and restorative justice. The course provides an overview of the theory, philosophy, process and legal issues involved in each of these methods of dispute resolution. Students are also encouraged to reflect on the ethical issues involved in dispute resolution including dealing with power disparities between the parties to a dispute, the role of third party neutrals in managing the process of dispute resolution, the level of state control over the processes and the development and application of professional standards for dispute resolvers.
